| The City of Akron and Akron Regional
Landfill, Incorporated (ARLI) have signed a letter of understanding that will close the
Fountain Street Transfer Facility as a permitted solid waste facility within three years
from the date a formal, written agreement is negotiated. A new solid waste transfer
station will be constructed and then available to accept the citys residential,
solid waste. On or before June 30, 2002, ARLI will
install, at its expense, a new odor control system at the Fountain Street facility. It
will also complete necessary construction and enhancements for improving waste handling
operations there. Following the June 30, 2002 closing of the Hardy Road Landfill, ARLI
will be permitted to accept City of Akron residential solid waste at Fountain Street, in
addition to other waste that may be transported there.
Mayor Don Plusquellic, in making the announcement this
morning said, "This is a practical compromise between the two parties on the issues
regarding the Fountain Street Transfer Station. Both sides recognize that a court ruling
could go either way so this is a compromise to achieve what the City wants---the closing
of the transfer station---and it allows the company time to find another location."
Two lawsuits were filed in August of 1999 appealing the
Citys decision to attempt to prevent the company, ARLI, from accepting household
solid waste. Under this agreement, the City will settle the cases in Summit County Common
Pleas Court and allow for the acceptance of municipal solid waste at the Fountain Street
facility.
